These Terms and Conditions ("Terms") constitute a binding agreement between you ("you", "participant", or "user") and NEXUSGIVE ("we", "our", or "the Initiative"). By accessing or using the NEXUSGIVE website, creating an account, participating in the spin experience, claiming prizes, purchasing or using VIP NEXUS cards, making donations, or otherwise using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services.

NEXUSGIVE is an invite-only charitable giveaway initiative. It offers eligible participants a single annual spin on a prize wheel for a chance to win designated prizes (cash and/or physical items). The initiative also offers VIP NEXUS cards (Silver, Gold, Platinum) that provide benefits and eligibility for higher-value prize claims, and allows users to support the mission through donations. NEXUSGIVE is not a bank, financial institution, or gambling operator; it is a private philanthropic initiative.

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use NEXUSGIVE. You are responsible for providing accurate information when registering (username, email, password) and for keeping your credentials secure. One spin per user per year is permitted; multiple spin attempts may result in access restrictions. We reserve the right to refuse or terminate accounts that violate these Terms or that we deem fraudulent or abusive.

When you spin the wheel, our algorithm randomly determines your prize - which could include cash amounts, vehicles, devices, or even a Mystery Box! If you win, we’re here to help you claim your prize easily and with minimal steps. Once you complete the simple claim process and we confirm your eligibility , your prize will be on its way to you. Delivery is handled promptly and reliably, though occasionally delays may occur due to circumstances outside our control. Rest assured, we’ll do everything we can to get your prize to you stress - free.

To claim a prize, you must submit the required information (e.g. name, address, contact details, VIP NEXUS card tier and number where applicable) through our claim process. High-value prizes may require an active VIP NEXUS card in the correct tier (Silver, Gold, or Platinum as specified). We will process claims in good faith and may contact you for verification or delivery coordination. You are responsible for providing accurate delivery details and for any customs, taxes, or fees that may apply in your jurisdiction.

VIP NEXUS cards (Silver, Gold, Platinum) are offered as part of the initiative. Purchase terms, pricing, and benefits are described on the platform. Payment may be made via specified methods (e.g. Bitcoin or other options as indicated); confirmation and activation of VIP status are subject to our verification. VIP benefits and prize claim eligibility are as described at the time of purchase. We do not guarantee availability of any tier or benefit and may update offerings with reasonable notice where appropriate.

Donations made through NEXUSGIVE (e.g. via Bitcoin or other indicated methods) support the initiative's mission. Donations are voluntary and generally non-refundable. We do not provide tax or legal advice; you are responsible for determining the tax treatment of your donation in your jurisdiction.

You may not: (a) use the platform for any illegal purpose or in violation of any law; (b) attempt to manipulate the spin, claim prizes fraudulently, or abuse the VIP or donation systems; (c) impersonate others or provide false information; (d) attempt to gain unauthorized access to our systems or other users' accounts; (e) scrape, automate, or overload our systems without permission; or (f) use the platform to harass, defame, or harm others. We may suspend or terminate access and take other action we deem appropriate for violations.

The NEXUSGIVE name, logo, website design, and content are our property or our licensors'. You may not copy, modify, or use them for commercial purposes without our prior written consent.

The platform and services are provided "as is" and "as available". We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

To the maximum extent permitted by law, NEXUSGIVE and its operators, sponsors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the platform, the spin, prizes, VIP cards, or donations. Our total liability for any claim arising from these Terms or the services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim (or, if no such payment, one hundred United States dollars (USD 100)). Some jurisdictions do not allow certain limitations; in such cases, our liability will be limited to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless NEXUSGIVE and its operators, sponsors, and affiliates from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the platform, your violation of these Terms, or your violation of any third-party rights.

We may update these Terms or the services from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may be communicated via the platform or email where appropriate. Your continued use of the services after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the services.

These Terms, together with the Privacy Policy and any other policies we publish, constitute the entire agreement between you and NEXUSGIVE regarding the services. If any provision is held invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision does not waive that right or provision. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Governing law and dispute resolution (including arbitration, if applicable) will be as specified in the version of these Terms in effect at the time of the dispute.
